The requesting office opens a public tender to procure a 3d geological modelling software (the software). The software must be a commercial “ready-to-run” solution. Cloud-based solutions, software-as-a-service solutions, a specific development for the requesting office and frameworks of individual, but interdependent software packages will not be taken into account.

The following services are considered as basic performances:
- The supply of the software

The documentation on the public call to tender for the project mentioned can be downloaded from the platform www.simap.ch under: Running procedures, Confederation, Invitations to tender. In order to do so, you first have to register in the above-mentioned project. You will then be able to log in and use the password received by e-mail to download the desired documentation.

The manufacturer of the Storage Software offers an API to its product. For confidentiality reasons, the documentation is not publicly available but may be obtained through the procurement office by the Tenderers on request. Companies willing to submit an offer must timely deliver the following documents:
- Duly signed confidentiality agreement (see "Specifications" chapter 10.4.6 and appendix 5);
- A certified copy of the current commercial register (not older than 3 months) or a similar official confirmation.
The original copy must be submitted as proof of suitability along with the offer.

Both documents have to be sent by the bidder and with the annotation “WTO project (18072) Geological 3D modelling software – confidential documents” to the contact address given in point 1.2.
The confidential components will be released to the bidder via e-mail upon receipt of the verification.
It is in the sole responsibility of the bidder to request these additional documents in time for the preparation of their offers.
NDAs submitted to the procurement authority less three business days before the submission deadline will not be considered.

Tenderers will be notified by e-mail as soon as any answers have been posted on www.simap.ch.

Question arising regarding appendix 5 and in consequence the referenced documents are to be sent by email within the deadline (03.08.2018) to beschaffung.wto@bbl.admin.ch.
Any answers will be sent out by email in anonymized form to all tenderers that signed the confidentiality agreement and ordered the referenced documents.

Any questions submitted after this deadline cannot be answered.

a)
When submitting to FOBL goods acceptance unit (by tenderer or courier):
The tender must be submitted no later than the above-mentioned submission date during the goods acceptance unit's opening hours (08:00–12:00 and 13:00–16:00) in return for issue of a confirmation of receipt from the FOBL.
b)
When submitting / delivering by post:
The date used to determine the timeliness of submission is the postmark date or barcode issued by a Swiss post office or a state-recognized postal operator in another country (corporate postmarks are not accepted as official postmarks).
c)
When submitting / delivering the tender to a Swiss diplomatic or consular mission abroad:
Tenderers based in another country may submit their tender, by the above deadline and during the opening hours, to a Swiss diplomatic or consular mission in their own country in return for issue of a confirmation receipt. The tenderer must then fax the confirmation of receipt from the respective mission by the submission deadline (see section 1.2).
In all cases, the tenderer must ensure that it secures evidence that the tender was submitted on time.
Any tenders submitted after the deadline will not be considered and will be returned to the tenderer.

Eignungskriterien:

All companies with sufficient economic capacity, which meet the following criteria and proof of suitability acc. to paragraph 3.8, are invited to submit a tender in CHF, USD, EUR or GBP.

Geforderte Nachweise:

The verification of competences must be submitted absolutely complete and without restriction or modification in writing. If not complete, the tender offer will not be evaluated.

EC1.1
Economic capability
The Tenderer disposes a sufficient economic capability to fulfill the mandate.
Proofs:
Certificate of registration/commercial register, certificate of enforcement register (not older than 3 months at the time being asked by the requesting office). Non-Swiss tenderers: Similar and up-to-date, official certificate. These certificates must be handed in on invitation, after the submission of the tenderer and prior the award.

EC1.2
Compliance with procedural principles
a) The Tenderer confirms that he himself as well as any subcontractors are compliance with the procedural principles in accordance with the self-declaration form of the Federal Procurement Conference FPC.
b) In addition to the self-declaration form, the Tenderer with more than 50 employees and their direct subcontractors with more than 50 employees have to provide evidence of how the wage practice was checked.

EC1.3
Legal compliance
The Tenderer confirms all of the following without exception:
a) The company has met all tax and social-security contributions.
b) The company is currently not the subject of a bankruptcy proceeding.
c) The company has not been in the past ten years in breach of any regulatory, tax or other government requirements.
d) The company has not had any court rulings against it.
e) The company is not currently the object of litigation.

EC1.4
Experience
The Tenderer has specific experience in the field of software development for geological purposes, software consulting, and solution development. The Tenderer is experienced in projects, which are comparable to the present call in terms of content and complexity. He proofs its experience based on 5 successful references not older than 5 years (relative to the submission deadline).
A reference is considered as successful, if the software provided is in operation at other clients in a similar environment and if the general development path of the software (e.g. functionalities through time) is proven.

EC1.5
Capacities
The Tenderer confirms that the services and work requested by swisstopo are granted either at any time during the duration of the contract (for functional support, technical support, maintenance; see description of Basic Services for support and maintenance in main document, chapter 4) or at mutually defined time periods (for optional services: training, consulting; for optional work: software development).

EC1.6
Contact person
The Tenderer has a single point of contact (SPOC) who is responsible for the escalation of problems concerning the contract and can make decisions.

EC1.7
Contact / Language skills
The Tenderer confirms that the requesting office
a) can contact its team during the weekly business hours defined in the maintenance agreement (minimum requirements in chapter 4) through a normal (e.g. non-business, toll-free) telephone number (land line) and
b) speak immediately in English or in one of the business languages defined with a qualified employee on the services being delivered.
c) Additionally, the Tenderer confirms to set up a “Skype for Business account” into operation to be used in any web conference.

EC1.8
Orientation of the company and product
a) The development of 3D geological modelling software is the only one or one of the main branches of the Tenderer.
b) The product offered by the Tenderer is principally focused on geological 3D modelling.

EC1.9
Time-on-market (company and product)
a) The Tenderer is actively present for more than 5 years on the market for commercial 3D geological modelling software (relative to the submission deadline) and
b) the product offered is actively marketed for more than 5 years as a commercial 3D geological modelling software (relative to the submission deadline).

EC1.10
Acceptance of Contract Template
The Tenderer confirms acceptance of the contract template, which denotes an integral part of the present procedure.

EC1.11
Acceptance of General Terms and Conditions
The Tenderer confirms acceptance of the following General Terms and Conditions of the Swiss Confederation:
- General Terms and Conditions for the Procurement and Maintenance of Standard Software (Edition 20.10.2010);
- General terms and conditions for IT works contracts and contracts for the maintenance of individual software (Edition 20.10.2010)
- General Terms and Conditions for IT services (Edition 20.10.2010)
These are valid for the present procedure with the changes (additions/alterations) laid down in chapter 10.4.2 of the main document of the invitation to participate.

EC2.1
Delivery of the Application
The Tenderer delivers the Application, according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.

EC2.2
Licenses
The Tenderer supplies the licenses of the Application, according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.

EC2.3
Maintenance
The Tenderer offers service and maintenance on an annual basis, according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.

EC2.4
Support
The Tenderer offers user support (software-related and technical), according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.

EC2.5
Initial training
The Tenderer offers an initial training session for up to 10 people. The training will take place at SGS headquarters.

EC3.1
Option: Licenses
The Tenderer supplies the licenses of the Application, according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.
Duration: Eight (8) years, service is called on a yearly basis.

EC3.2
Option: Maintenance
The Tenderer offers service and maintenance on an annual basis, according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.
Duration: Eight (8) years, service is called on a yearly basis.

EC3.3
Option: Support
The Tenderer offers user support (software-related and technical), , according to the requirements of this tender, see in particular sections 1, 3 and 4 of the specification document and the contract.
Duration: Eight (8) years, service is called on a yearly basis.

EC3.4
Option: Software development projects
The Tenderer agrees to the development of additional software projects in order to add new or extend existing functionality to its own software package.
A total of 900 hours (= 0.5 FTE) of development per optional work is estimated (period 2020–2028; 4 calls, 3600 hours). This estimation includes work for project management, software development and testing.
Be advised that four optional software development projects at the maximum may be called for.

EC3.5
Option: Refresher training
The Tenderer agrees to provide refresher training on demand, during the duration of the contract.
- The Tenderer provides a refresher training session for up to 10 people. The training will take place at SGS headquarters.
- The Tenderer offers an refresher training session for up to 10 people, the training may take place through online tools or computer based training.
The same pricing rules apply as for the initial training.

EC3.6
Option: Consulting
The Tenderer agrees to provide additional consulting (workflow development, specific training, specific problem solution etc.) on demand, for the duration of the contract.
A total of 50 hours per year of consulting services is estimated (period 2020–2028; total 450 hours). This estimation includes consulting for workflow definitions, reviewing of work done by SGS etc.
Price(s) must be listed on a per hour basis.

EC3.7
Option: Additional licenses
The Tenderer agrees to provide additional licenses on demand during the duration of the contract. Prices must be listed on a per license basis.

Nachverhandlungen:

Negotiations are reserved. The requesting office will not conduct any price negotiation rounds. Only if special circumstances such as the clarification or specification of the requirements so warrant and if the requesting office exceptionally and explicitly permits it with invitations to possible negotiations will the tenderers get the opportunity to adapt their prices.

Grundsätzliche Anforderungen:

The contracting authority awards public contracts for goods and services provided in Switzerland only to tenderers guaranteeing compliance with workplace health and safety regulations and employee working conditions, as well as equal pay for men and women.
If the place of performance is abroad, the tenderer must guarantee compliance with at least the Core Conventions of the International Labour Organization in accordance with Annex 2a of the PPO.
The self-declaration of the Federal Procurement Conference (FPC), "tenderer's self-declaration concerning compliance with minimum social requirements" is to be signed and enclosed with the tender.

Sonstige Angaben:

Subject to the procurement maturity of the project for the purchase and the availability of the credits.

The contracting authority reserves the right to have the awarded goods and services provided also to other offices requiring these goods and services in the Federal Administration, as well as to procure the goods and services defined as optional in their entirety, in part or not at all.

Successful tenderers agree to adapt their prices accordingly if there is a fall in market prices in the course of the procurement period. The decision as to whether or not prices have fallen will be based on the time of full or partial delivery. The contracting authority reserves the right to issue another call for tender if, in the course of time, the selected tender is no longer the most commercially advantageous one.
