1a. For services provided in Switzerland
The contracting authority shall award public contracts for services in Switzerland only to a provider (hereinafter referred to as provider) which guarantees compliance with occupational health and safety regulations and working conditions for employees and equal pay for men and women.
1b. For services provided abroad
If the service is provided abroad, the provider must at least ensure compliance with the following core conventions of the International Labour Organisation (ILO core conventions):
- Convention No. 29 of 28 June 1930 concerning forced or compulsory labour (SR 0.822.713.9);
- Convention No. 87 of 9 July 1948 concerning Freedom of Association and Protection of the Right to Organise (SR 0.822.719.7);
- Convention No. 98 of 1 July 1949 concerning the Application of the Principles of the Right to Organise and to Bargain Collectively (SR 0.822.719.9);
- Convention No. 100 of 29 June 1951 concerning Equal Remuneration of Men and Women Workers for Work of Equal Value (SR 0.822.720.0);
- Convention No. 105 of 25 June 1957 concerning the Abolition of Forced Labour (SR 0.822.720.5);
- Convention No. 111 of 25 June 1958 concerning Discrimination in Respect of Employment and Occupation (SR 0.822.721.1);
- Convention No. 138 of 26 June 1973 concerning the minimum age for admission to employment
(SR 0.822.723.8);
- Convention No. 182 of 17 June 1999 concerning the prohibition and immediate action for the elimination of the worst forms of child labour (SR 0.822.728.2).
2. compliance with minimum social standards by subcontractors and subcontractors
The client requires that the subcontractors and subcontractors also comply with the minimum social standards listed above. If a subcontractor or subcontractor provides its services in Switzerland, it must comply with the minimum social regulations applicable in Switzerland pursuant to section 1a; if it provides its services abroad, it must at least comply with the ILO core conventions pursuant to section 1b.
A self-declaration must be submitted for confirmation.
The project's readiness for procurement and the availability of credits remain reserved.

In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA.
