The tender documentation is available in German and English. In the event of contradictions between the versions, the German version will prevail.

Further information on obtaining the tender documentation: you can download the documents online from the electronic platform at www.simap.ch, section "Public procurements, Confederation tenders". To do so, you have to register in the project and can then download the desired documents using the login and password sent to you by email. A questions forum is also available.

Source for obtaining confidential appendices/enclosures
The tender documentation contains confidential documents (see *marked items under 10.1 Specifications). In order to gain access to these documents, the tenderer must send a scanned copy of the personally signed confidentiality obligation (annex 2) to the following address: beschaffung.wto@bbl.admin.ch.
The tenderer will be granted access to the confidential documents once the duly signed confidentiality obligation has been received and checked.
The tenderer is responsible for requesting these documents in good time (see also deadlines for tender submission).

a)
If handed over to the FOBL goods acceptance unit (by the tenderer or a courier): the tender must be submitted no later than the above-mentioned submission date during the goods acceptance unit's opening hours (08:00-12:00 and 13:00-16:00) in return for issue of a confirmation of receipt from the FOBL.
b)
When submitting by post: the date used to determine the timeliness of submission is the postmark date or barcode issued by a Swiss post office or a state-recognised postal operator in another country (private or corporate postmarks are not accepted as official postmarks). In case of dispatch using WebStamp franking, the burden of proof for timely submission lies with the provider.
c)
When submitting the tender to a Swiss diplomatic or consular mission abroad:
tenderers based in another country may submit their tender, by the above deadline and during the opening hours, to a Swiss diplomatic or consular mission in their own country in return for issue of a confirmation receipt. The tenderer must send this confirmation of receipt to the procuring entity by the submission deadline by e-mail (beschaffung.wto@bbl.admin.ch).

In all cases, the tenderer must ensure that it receives proof that the tender was submitted on time.
Any tenders submitted after the deadline will not be considered and will be returned to the tenderer.

  • dLIS provides a platform for digitally processing and monitoring all licence applications submitted to FOCA. This includes licences for: • Pilots (FCL) • Maintenance personnel (MPL) • Air traffic controllers (ATCO/SRT) • Operators of unmanned aircraft systems (UAS) • UAS-related organisations dLIS provides a user account tailored to the user role. This account contains a dashboard providing an overview of all licence information, including personal history. The various applications are controlled via workflows and their completeness is checked using conditions trees. The course and examination administration can also be managed via dLIS.

2: Digital Theory Examination dExam

  • dExam is the application for organising theory examinations on mobile devices (FOCA iPads) and online for various licences and permits. Theory examinations are currently held on around 120 examination dates at the following locations in Switzerland: • Ittigen (FOCA) • Zurich (FOCA) • Lausanne • Bellinzona • Illnau Online examinations are provided for remote pilots. FOCA currently provides examinations in the following areas: • Pilots (all licence categories and levels) • Maintenance personnel • Personnel assessments • Operators of unmanned aircraft systems • Certification of safety instructors • Air traffic controllers This application will be procured through this call for tenders.

Zulassungsbedingungen

Bietergemeinschaften:

Permitted. If the tenderer takes part in a bidding consortium, it must designate a company that will take the lead (representation, coordination). The tenderer will list all parties concerned and their allocated roles.
A member of the consortium will ensure characteristic performance.
Multiple tenders by tenderers as part of bidding consortia are permitted.

Eignungskriterien:

All companies with sufficient economic capacity that can prove their eligibility or meet the eligibility criteria as set out in section 3.8 are invited to submit their tenders in Swiss francs (CHF).

Geforderte Nachweise:

The following proof of eligibility must be confirmed or enclosed in full and without restrictions or modifications together with the tender itself; otherwise, the tender will not be considered.

EC01 Economic/financial standing
The tenderer possesses sufficient economic/financial standing to perform the contract.
Evidence
Extract from the debt enforcement register not more than three months’ old from the time of the awarding authority’s request. Tenderers abroad must submit equivalent, current official documents issued abroad.
Please note: The awarding authority will electronically verify the extract from the Central Business Names Index (www.zefix.ch).
Tenderers abroad must submit an extract from the commercial register or an equivalent, official document issued abroad.
This evidence of eligibility must only be submitted on request after submission of the tender and before the awarding of the contract.

EC02 Experience
The tenderer or its subcontractors possess sufficient experience of projects that are comparable with this tender in terms of the development of similar systems, integration into third-party systems and the development of mobile apps. It will provide evidence of this experience by submitting two references from the past five years.
References concerning projects carried out by the tenderer for the Swiss Confederation will only be permitted provided the referees indicated have given their consent in writing to provide information.
Evidence
A fully completed reference form (Annex 4/Annex 5) must be submitted for each reference project. The awarding authority reserves the right to contact the contact persons indicated. The contact person indicated must be reachable (details of holiday absences and deputies must be provided).

EC03 Human resources
The tenderer has the human resources required to perform the contract as described in the specifications document.
Evidence
Written confirmation with verifiable documentation of the human resources deployed for the contract.

EC04 Contact partner
The tenderer has a single point of contact (SPOC) who bears responsibility in the event of the escalation of contract-related issues and has decision-making authority.
Evidence
Written confirmation providing the surname, first name, contact details, job title and deputy of the SPOC.

EC05 Language skills of project employees
The tenderer must use employees for the project who can communicate in German or English (spoken and written proficiency), possess industry-specific knowledge of English and can produce and deliver the project results and documentation in German or English.
Evidence
Written confirmation with verifiable documentation of the language skills of the employees involved in the project.

EC06 Languages for software maintenance, support and further development
Software maintenance and support requests must be accepted in German, French and English and answered in German or English. The tenderer's staff who are in contact with the awarding authority in software maintenance and support roles must be able to communicate proficiently in these languages.
Evidence
Written confirmation with verifiable documentation of the language skills of employees.

EC07 Replacement of employees
The tenderer is prepared to replace the employees deployed for well-justified reasons:
The performance and commitment of the employees deployed by the tenderer will be assessed by the awarding authority. If any discrepancies with the requirements and criteria set out in the specifications document are established, the tenderer will be required to provide a response. The awarding authority will then decide whether the tenderer will be obliged to replace the persons concerned within a 14-day period with personnel who meet the requirements.
As part of contract performance, other well-justified reasons for the replacement of personnel may arise, such as negative personnel security screening by the Swiss Confederation, termination of employment, extended holiday leave, accident, illness etc. The tenderer is responsible for replacement with an equally well-qualified person. Involvement in other supplier projects is not deemed a well-justified reason.

In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included.
The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA.
