The project TK A, Ersa IMFS seeks to implement and meet the demands for more communications capacity (language and data) with increased mobility in combination with increasing pressure on the financial and personnel resources available, by means of an innovative and integral solution.
In this process, it is necessary to replace the IMFS which has truly proven itself, except for the outdated technology and the resulting limitations. The IMFS has been continuously optimised since its introduction and adjusted according to needs to the extent possible.

Essential eligibility criteria

E1.01 Extract from the debt enforcement register and commercial register
Extract from the debt enforcement register and commercial register or the equivalent recognised documentation from the foreign country (not older than three months, the date of entry is decisive) which proves that the applicant has no tax or social security debts.

E1.02 Supplier self-declaration

E1.03 Procedural principles
a) Compliance with basic procedures
The applicant confirms that it – along with any third parties contracted by the applicant (subcontractors and sub-suppliers) – complies with the basic procedures according to the self-declaration form (Template 5.1) published by the Federal Procurement Commission (BKB).
b) Additional proof of compliance with equal pay requirements for women and men
Applicants with more than 50 employees and their first-tier subcontractors with more than 50 employees each must – in addition to the self-declaration form – document how their remuneration practices have been audited.

E1.04 Overall responsibility for this project
The applicant confirms that it shall assume overall responsibility for this project and, in particular, that the applicant is the sole contractual partner of the contracting authority. Any other parties involved must be listed in Template 5.4 along with their assigned roles/functions.

E1.05 Security procedures/Personal security check
The applicant agrees to undergo the security procedures which encompass various security measures (c.f. Ordinance on the Security Procedures, SR 510.413).
The federal information protection regulations (in particular the Ordinance on the Protection of Federal Information, SR 510.411) shall be applied.
This applies to companies (contractors and all subcontractors) and persons.

E1.06 Confidentiality agreement
The applicant accepts the confidentiality agreement A for contractors and B for persons entrusted with confidential information (requirement for the invitation to submit a proposal).

E1.07 Confirmation for subsequent procurements
The applicant undertakes to guarantee production capacity for any subsequent procurements for a period of 10 years until 2032 at the latest from signing of the contract (procurement contract).

E1.08 Provision of replacement parts
The applicant guarantees the supply of spare parts of the entire procurement scope over the entire Useful life of min. 10 years after full performance of the contractual services (procurement contract).

E1.09 Experience of the applicant
The applicant has evident experience in the design of tactical networks in a comparable scope (comparable in applied technology, components and systems) and provides evidence of this experience with references for the last 10 years (not older than 2008).

E1.10 Servicing and maintenance
The applicant authorises the Armed Forces Logistics Organisation (AFLO) or a third-party company named by armasuisse to arrange all servicing and maintenance work to be carried out by trained specialist personnel. The specialist personnel (troop, AFLO and supply centre) must be trained by the applicant.

E1.11 Procedure for providing evidence for norms and standards
The applicant confirms that it accepts the procedure for providing evidence for its system/its system components as described in the annex "Procedure for providing evidence for operational electrical security and EMC" (Annex 1.1.7).

E1.12 Crypto components
The applicant confirms that all crypto components used in the system are verifiable (e.g. by viewing the source code, white box testing, or similar) and it shall provide all documents required for approval to DDPS.

E1.13 Verification requirements
The applicant confirms that it shall formulate at least one verification requirement according to ISO 29148 or similar per requirement in its technical specification in consultation/cooperation with armasuisse during the evaluation phase.

E1.14 Integration and implementation of system components into vehicles
The applicant confirms that it shall arrange all planning and execution steps with the supply centre of the respective vehicle for vehicle integration work, approve the same and arrange acceptance after completion, such that the respective vehicle possesses the necessary permit again following integration and can re-enter operation in a timely manner. (Details in this regard can be found in Annexes 1.1.6 and 1.1.8).

E1.15 Audits
In order to verify the correct implementation of the technical specifications or processing requirements, the awarding authority may conduct project-related audits. The applicant agrees to be available for such audits at the request of the awarding authority and to disclose all requested information as well as ensure access to the relevant facilities. Compensation for costs thereby incurred on the part of the applicant shall not be provided.

E1.16 Experience of personnel
The key persons (Template 6, K2.7 - K2.10) shall demonstrate that they have experience in the management/design of comparable (comparable in complexity and at least two of the following three criteria: applied technology, components and/or systems) projects. The evidence shall be provided with a description of similar projects in the last 10 years.
The references may have begun earlier but should have been completed within the last 10 years. In the case of ongoing projects, a major part >70% must have already been completed.

E1.17 Data processing/Data backup
The applicant confirms that all project data, which it processes itself along with any third parties contracted by the applicant (subcontractors) or receives from the awarding authority/consumer, are only stored and processed in information systems in Switzerland. Data processing refers to any operation with data, regardless of the applied means and procedures, in particular the collection, storage, use, alteration, disclosure, archiving or destruction of data. This clause applies to all data which the applicant processes from the date of the submission deadline for the request to participate, in particular also to data from temporary storage or peripheral data. Access to the data from abroad is not permitted.

E1.18 Swiss law and jurisdiction
The applicant accepts that all contracts with the awarding authority stipulate Swiss law and the jurisdiction of Bern. The applicant also confirms that it has stipulated Swiss law and a Swiss jurisdiction in all contracts with subcontractors relevant to contractual performance. At the request of the awarding authority, the applicant shall disclose the corresponding contract extracts and the associated contracts. A change affecting subcontractors is only permissible with the prior approval of the awarding authority.

E1.19 Personnel resources
The applicant confirms that the necessary personnel capacities are available for the evaluation and testing from 1 October 2019 until 31 December 2022.
The applicant confirms that all offered and deployed persons have or will have legal residence status for the duration of the planned service, which permits them to engage in employment in the offered scope in Switzerland.

E1.20 Project language
The applicant confirms that the persons deployed locally at the customer speak fluent German and are also able to articulately express themselves in written German. German skills facilitate professional cooperation in the project.

E1.21 Documentation
The applicant confirms that it shall prepare all documentation in German or in accordance with the instructions of the awarding authority/user.

E1.22 Data protection
The applicant confirms that it is aware of and complies with the statutory provisions in particular on data protection and data security (https://www.admin.ch/opc/de/classified-compilation/19920153/in-dex.html).

Eligibility criteria with possible restrictions

E2.01 Cooperation with partners prescribed by the awarding authority
The applicant confirms that it will cooperate with further partners of the awarding authority without restriction, provided this is required by the project in the view of the awarding authority. Note: Since the project is embedded in peripheral systems and other projects, cooperation with other partners is imperative.

E2.02 Adoption of the solution of the awarding authority
The applicant confirms that it will also adopt solutions (in particular the Voice subsystem) of the awarding authority with corresponding functionalities for parts of its solutions, provided these are interoperable and integrable with its own system.

E2.03 Compliance with standards on integration and implementation, test procedures
The applicant confirms that it will provide the qualifications and know-how for the integration and implementation as well as necessary test procedures (through subcontractors, if applicable) in order to ensure certifications and approvals.

E2.04 Draft agreement
The applicant confirms acceptance of the draft agreement (Annex 10).
